Who provides BabyDuo

David Ammer, Austria — contact: support@ammerbrothers.at ("we"). These terms govern your use of the BabyDuo mobile app and its server. How we handle your data is described separately in our privacy policy.

What BabyDuo is

BabyDuo helps two people choose a baby name together: you swipe through a catalogue of names, your partner does the same, and names you both like become a match. Names, origins and statistics in the app are offered for orientation and entertainment. They are compiled from official statistics and public sources and may be incomplete or out of date — nothing in the app is legal advice about whether a name may be registered where you live. Naming rules are set by your local registry office, not by us.

Popularity figures in the app combine real likes with seeded values based on public name statistics; they are for orientation and are not a count of BabyDuo users.

Who may use it

You must be at least 16 years old to create an account. By registering you confirm that you are, and that the information you give us is correct.

Your account

You need an account to use the app. Keep your password to yourself; you are responsible for what happens under your account until you tell us it has been compromised. Use one account per person and give an email address you can actually receive mail at — an unconfirmed address cannot be used to sign in, and it is the only way we can send you a password reset. We may suspend or delete an account that breaches these terms, is used to harass someone, or is used to attack or automate against our service.

Names you suggest

You can add a name that is not in the catalogue. It is dealt only into your partner's deck — never to strangers, and never into the public catalogue. You keep whatever rights you have in what you submit and grant us only the limited permission needed to run the service: to store your suggestion and show it to the partner you are linked with. Do not submit anything unlawful, abusive, hateful, or designed to insult a real person; suggestions are capped per day to keep that manageable. We may remove a suggestion without notice, and every name you suggested is deleted along with your account.

Linking with a partner

Linking always takes both sides: entering someone's partner code sends a request, and only the owner of that code can accept it. Once linked, the names you suggest are dealt into your partner's deck — anonymously, so they swipe without knowing the name came from you. It is only when the two of you match on one that they are told you suggested it, and only while "Reveal my suggestions" is on in Settings. They also see your matches with them. Choose who you link with accordingly, and see the privacy policy for the full list.

Advertising

The free app is funded by ads, shown at limited points such as when your swipe energy runs out. In the European Economic Area you are asked for advertising consent first; you can change that choice at any time under Settings → Privacy → Privacy options. Details are in the privacy policy.

The ad-free pass

You can buy a pass that removes ads for 7 days. It is a one-off purchase, not a subscription: it does not renew, nothing is charged again, and it simply expires. The price shown in the app is set and collected by Apple's App Store or Google Play, and your contract for the payment itself is with them — so refunds run through their processes, not ours. If a pass you paid for is not showing, use Settings → Restore purchases first, then write to us.

Right of withdrawal. As a consumer in the EU you normally have 14 days to withdraw from a distance contract. A pass starts working the moment it is granted, and by buying it you expressly ask us to begin performance immediately and acknowledge that you thereby lose that right of withdrawal once it has been fully performed. Your statutory warranty rights are unaffected: if the pass does not work, tell us and we will fix it or refund it.

Availability

BabyDuo is offered as it is. We do not promise any particular uptime, and the service may be interrupted for maintenance, by problems at providers we depend on, or by your own connection. We may change features, and we may discontinue the app — if we discontinue it, we will give reasonable notice where we can and will not keep money for pass time you never got to use.

Ending it

You can stop at any time by deleting your account in the app (Settings → Delete account), which removes your data as described in the privacy policy. We may terminate your access for a serious or repeated breach of these terms; where the breach can be put right, we will normally ask you to put it right first.

Liability

We are liable without limitation for injury to life, body or health, and for damage caused intentionally or by gross negligence. For slight negligence we are liable only where an obligation essential to this agreement is breached, and then only for the damage typically foreseeable in a contract of this kind. Nothing here limits liability that cannot be limited by law, and your mandatory rights as a consumer are not affected.

Changes to these terms

We may update these terms — for example when a feature changes or the law does. The current version is always at this address and carries the date above.

Before a changed version takes effect we will point it out in the app at least 30 days beforehand and say what has changed. You may object within that period by writing to support@ammerbrothers.at; if you do, the new version is not applied to you and the agreement between us ends — on the day the change takes effect, or, if an ad-free pass of yours is still running then, when that pass expires, so that nothing you paid for is cut short. If you neither object nor delete your account within that period, the new version applies from its effective date — staying is agreement only after this notice, and only to the changes it announced.

Either way a change never alters an ad-free pass you have already paid for: a pass that is running keeps the terms it was bought under until it expires.

Applicable law

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in another EU or EEA state, this choice does not deprive you of the protection of the mandatory provisions of the law of your country of residence. Please write to support@ammerbrothers.at first if something is wrong — most things are settled fastest by email.
